Adult film star Stephanie Clifford, a.k.a. Stormy Daniels, is suing President Donald Trump to release her from the nondisclosure agreement she was paid to sign to keep quiet about an alleged affair he had with her in 2006. Daniels and her lawyer claim that while both she and Micheal Cohen, Trump’s personal lawyer, signed the NDA, Donald Trump himself did not, making the agreement invalid.

The court filing, obtained by NBC, includes what it refers to as the “hush agreement” where Donald Trump is referred to as “David Dennison.” There are blanks throughout where “DD” was supposed to sign, but did not. Daniels’ lawyer, Michael Avenatti, spoke about the suit on The Today Show Wednesday, saying that Daniels wants a chance to tell her story and confirming that she had “a sexual relationship with the president.”

Reports that Trump had an affair with Daniels in 2006, a few months after Melania Trump gave birth to the couple’s son Baron, surfaced earlier this year. In February, Michael Cohen, who remains Trump’s personal attorney, admitted to paying Daniels $130,000 out of his own pocket during the campaign to keep the porn star quiet. Since then, questions have been raised about if Cohen actually paid using his own money and there is speculation the Trump campaign may have illegally used campaign funds for the payout.

In January, during Trump’s State of the Union address, Daniels did an interview with Jimmy Kimmel where she refused to either confirm or deny a relationship but basically confirmed that she had signed an NDA when Kimmel said “you can’t say you have a non-disclosure agreement, but if you didn’t have a non-disclosure agreement, you most certainly could say, ‘I don’t have a non-disclosure agreement.’ Yes?” to which Stormy replied, “You’re so smart, Jimmy.”

Kimmel also referred to salacious details published in an InTouch interview Daniels did with the outlet in 2011 but was not published until mid-January 2018. In the article, she not only confirms the affair, but describes how she met Trump and gives graphic details about their encounter.

Trump has been quiet thus far on the latest developments in the Daniels case, begging the question from experts: will POTUS ignore the legal action and risk a court allowing Daniels to speak freely about the affair or will he defend himself in court and thereby confirm he has something to hide?
